1. Your Ownership
You retain all ownership rights in the User Content you provide. We do not claim ownership of your media, brand, or customer data.
2. License to Use
By providing User Content to PDC Media, you grant us a non-exclusive, royalty-free license to use, reproduce, modify, and distribute that content solely for the purpose of delivering the services you've engaged us for — including running ads, building landing pages, and producing reports.
3. Your Representations
By submitting User Content, you represent and warrant that:
- You own the content or have the necessary rights, licenses, and consents to use and share it.
- Any people shown in photos or videos have signed model releases or otherwise consented to commercial use.
- Customer data you share with us was collected lawfully and with appropriate consent.
- The content does not infringe on any third party's intellectual property, privacy, or other rights.
- The content is accurate, not misleading, and complies with applicable advertising regulations (including FTC and platform rules).
4. Prohibited Content
You may not submit content that:
- Is unlawful, defamatory, harassing, hateful, or otherwise harmful.
- Contains before/after imagery without proper patient consent.
- Makes unsubstantiated medical claims or guarantees.
- Contains malware, scraping tools, or other malicious code.
- Violates HIPAA, GDPR, CCPA, or other privacy regulations.
5. Testimonials and Case Studies
Unless you opt out in writing, we may showcase your business name, logo, results, and testimonials as case studies on our website, in marketing materials, and in pitches. You can revoke this permission at any time by emailing us.
6. Removal
We may remove or refuse to use User Content that we believe violates this policy or exposes us to legal risk. You can request removal of your content from our marketing materials at any time by emailing help@pdcmediaa.com.
7. Indemnification
You agree to indemnify and hold PDC Media harmless from any claims arising from User Content you provided that violates the representations above.
